Spousal Support, is also known as Alimony
Your choice of alimony lawyer may impact the rest of your life. Alimony is not always granted. There is both short-term, and long-term, even lifetime alimony. We can assist you in receiving or paying what is just and appropriate.
The Most Important Things About Alimony
You can find a list of criteria for how a judge would decide Alimony on any law firm’s website,
including lifestyle, educational background, etc. However, two crucial questions are frequently
- What is the need of the party seeking Alimony?
- What is the capacity of the party being asked to pay Alimony?
Divorce frequently results in a change in financial circumstances for one or both parties. Alimony may be granted to a party to maintain a certain standard of living. Some of the reasons for this include, but are not limited to, being the lower-earning spouse or being a stay-at-home parent.
Brandon Legal Group’s Family Law attorneys can guide you through the entire alimony process, including payment amounts, durational alimony, and permanent alimony. If an agreement cannot be reached, the court will determine whether alimony is required and the amount.
Frequently Asked Questions
- How long is Alimony paid for?
Following Florida’s family laws, Alimony or spousal Support may be granted temporarily and is frequently paid for a predetermined time. By agreement of the parties, Alimony or maintenance may also be renegotiated or left unchanged. How long you were married is one of many variables affecting maintenance length.
- Can Alimony be changed?
In Florida, unless the parties agree otherwise, the court can change maintenance. The parties may decide upon the amount and duration of maintenance. If maintenance can be changed, it will remain changeable (unless later on it is terminated or the parties agree to something else).
- Alimony vs Child Support, what’s the difference?
Both maintenance and child support payments support the necessities of a family, but they are based on two legal frameworks. The amount paid for one payment can affect the amount of the other, even though each payment is distinct from the others.
Debunking Florida Alimony Myths
Men pay alimony forever.
Most people believe men must pay alimony for life. Both false. This may have been true when men worked, and women stayed home, but today many wives make more than their husbands. So a woman may owe her ex-husband money. Most courts order alimony for a limited time. When people get lifetime payments, it’s usually because their ex-spouse has high medical bills. Most people only get alimony for a short time, so they should go to school or get training.
Alimony is a form of punishment.
Alimony isn’t intended to punish one party while rewarding another. The court made it, so both parties left the marriage on equal footing. When both parties make the same amount, there may be no alimony. The court wants to ensure the alimony payer can live reasonably. If you’re worried about alimony, get a prenuptial agreement.
It’s better to just pay a lump sum.
Spousal support is a good way to financially support your ex-spouse. Alimony is tax-deductible. This may sway you to pay spousal support instead of giving your soon-to-be ex-spouse money from your 401(k).
Second, paying spousal support monthly can help you protect and grow your assets, including your home, retirement funds, and investments. More equity can boost your assets’ value. If you don’t use those assets as alimony, you can increase your wealth.
