What happens if I own my own business?
A lot of people create businesses over many years and are not keen to surrender 50% of the earning capability in a divorce. The fate of the corporation will depend on how it was built. Most enterprises started prior to the marriage will go to the partner who started it. If the business was maintained by the marriage, then the assets might be regarded as community property and would get divided. If the business was created in the course of the marriage, then it might be split evenly between the individuals. This rule does not imply that your partner would actually get to hold on to the company, but he/she could get additional assets of value.
