Is it Necessary for an Unmarried Mother to File for Custody?
Until paternity is confirmed, an unmarried father in Florida has no legal rights to custody or timesharing.
The mother has sole legal and physical custody of the kid or children until paternity is formally confirmed through the courts. Mothers who are not married are automatically the only legal and physical caretakers of their children when they are born in Florida. Unmarried fathers, on the other hand, have the right to seek for custody in family court if paternity has been legally established.
