How Will Our Marital Property Be Separated?

Two major factors determine how marital property is separated during a divorce: 1) whether your state is a community property state or not; and 2) Whether the property in question is classified as separate or marital property. In any event, be prepared for a major fight with your spouse as it pertains to who gets what during the divorce.

If possible, it is best to have an amicable discussion with your spouse beforehand, to get an idea of where he or she stands regarding the marital property.

Your attorney can advise you on how your state’s laws apply to your specific divorce.
