Myth #2-Leaving Marital Home means Losing Your Rights to It
A spouse will not lose rights to the marital home, simply because they left the home.
Often one spouse will leave the home with the children, sometimes as a result of violence or to keep the child(ren) from being involved in arguments. It is not unusual that the spouse the left with the children, ends up with full rights to the marital home in the divorce trial. Whether or not a spouse has left the home, has no bearing on the outcome of the divorce case in general, or which spouse, if any, gets possession of the marital home.
