Myth #8 – Bankruptcy Voids Child Support Obligations

THIS IS NOT TRUE! 
 

To the contrary.  Having debts forgiven through bankruptcy means that bankrupt parent should have more funds available to pay child support.

This is not a state issue, but federal.   Nowhere in the US allows the discharge of child support obligations as a result of bankruptcy.

HOWEVER

If bankruptcy is caused by a negative major life event, it is possible to petition the court for an adjustment to child support based on different life circumstances.  It is then up to the judge to determine whether or not to grant any relief.
