Private Mediation v. Court Ordered Mediation

Contested dissolution of marriage, divorce, normally requires both parties to attend mediation prior to going to trial.

You may choose to have a court ordered mediator or you may choose to go to a private mediator such as Brandon Legal Group. The main difference between a court ordered, and a private mediator is their cost and their availability.

Court ordered mediators are traditionally cheaper than private mediators, but can also delay your case based on availablitiy. Typically we can mediate your divorce months in advance of the jam packed court system. We can also bring our years of experience (currently practicing) and understanding of family law into your matter and help create amicable results for all parties involved.

Private Mediation before Divorce Filings

Choosing private mediation prior to filing for divorce can be a large money saver for couples who have come to the conclusion that their marriage is over.

This option is not for every couple however, but for those who have a good outline on how the breakup will occur and how their belongings and childcare will move forward.

    Do I need to go to mediation?

    Mediation can be an effective tool to assist parties with conflicted views to come to an amicable agreement.

    If you are struggling to come to an agreement on only a few items with the other party, mediation may assist in coming to an agreement quickly and without the additional expense of attorney fees.

    Mediation may also be mandated by the Court before going to trial in front of a judge.

    Mediation is not for everyone, and sometimes the differences are too far apart, but in other cases it is an effective tool and can minimize the overall costs of a divorce.

    What happens after mediation?

    What happens after mediation?
    There are several possible outcomes following mediation.

    One option if all terms are agreed upon between both parties is for both sides to file the appropriate paperwork and finalize their action.

    However, if no agreement is made, you may choose to continue negotiating outside of mediation until an agreement is made, or decide that it is time to start preparing for a trial.

    How much does mediation cost?

    Mediation costs are typically based upon a base rate for a specific time-slot and then hourly for the mediators time spent.

    In addition, if you have an attorney, you would be responsible for their fees and time as well.

Debunking Florida Mediation Myths

Effective lawyers don’t need to use mediation.

Mediation is generally a requirement of the court. Additionally, an effective mediator is impartial and autonomous. After a mediator evaluates the case’s strengths and weaknesses, parties may be persuaded to reconsider their settlement positions along with the expenses, difficulties, and delays associated with litigation. An expert neutral mediator can identify innovative options for resolving disputes that the parties may not have considered. Even when negotiations have stalled, a never-say-die mediator can pressure parties to agree, even in hostile conditions.

Mediation won’t protect my rights.

 

You may be great at a lot of things, but when is the last time you were lead counsel in a criminal matter? Every individual has a constitutional right to experienced legal counsel no matter the magnitude of the matter. In many instances, the Court may prefer working with experienced Counsel rather than a layman, as all litigating parties will be held to the same legal standard and process.

The mediator represents both disputing parties.

Mediators should emphasize that they are a “neutral party” to whatever dispute is being mediated in the first meeting and in the retainer agreement, which all parties must sign. The mediator’s role is to support the parties in reaching an agreement on the points of contention. The mediator’s role is not to imply that an agreement is favorable or unfavorable to one side or the other.

In 2008 after gaining years of experience under the watchful eyes of her predecessors, Ms. Hooglander opened her own private practice that has grown into what Brandon Legal Group is today.

Her weight lifting and Kick Boxing training contribute to a reputation as a "force of nature" in both her personal life and her presence in the court room.

Mr. Mattson found his niche in family law and has focused his practice in that area since 2000. In particular, Luke often handles matters involving divorce, timesharing, parenting plans, child support, alimony, paternity, and civil domestic violence.
